These terms govern all interactions with TCG-AKIBA, including inquiries, negotiations, quotations, purchases, shipments, and other business activities.

Your use of our services—including communication via Instagram, WhatsApp, or Email (contact@tcg-akiba.com)—constitutes your acceptance of these Terms of Service. If you do not agree with any part of these terms, please refrain from using our services.

We may update or amend these Terms at any time by posting revisions on our website. Continued use of our services after changes are posted indicates your acceptance of the updated terms.

SECTION 1 – BUSINESS ELIGIBILITY

By using our services, you confirm that:

  • You are at least 18 years old and legally capable of entering contracts.
  • You operate a legitimate business (retail, e-commerce, content creation, or resale).
  • You comply with applicable international trade laws and import/export regulations.
  • You will not use our products for unlawful or unauthorized purposes.

We may request proof of business operation for first-time customers. Failure to meet eligibility requirements may result in refusal or termination of service.

SECTION 2 – COMMUNICATION & ORDER PROCESS

We do not accept negotiation or communication through any other platform. Communications from other channels will not be considered official and may be ignored.

Order Flow

  1. Product inquiry and quotation request.
  2. We issue a Pro Forma Invoice.
  3. You submit payment using an approved method.
  4. We confirm payment and dispatch schedule.
  5. Shipment with tracking information provided.
  6. Delivery and customer confirmation.

All orders are manually processed to ensure accuracy and personalized B2B service.

SECTION 3 – PRODUCT AUTHENTICITY & QUALITY

TCG-AKIBA sources products from recognized Japanese distributors and wholesalers. While we take steps to maintain product quality and accurate descriptions, the specific provision of verification documents or guarantees is not universally promised in every transaction. Any representations about sourcing, provenance, or condition provided in a specific quotation or invoice will govern that particular transaction.

SECTION 4 – PRICING & PAYMENT TERMS

All prices are quoted in USD unless otherwise specified. Prices may change based on market conditions.

Payment Policies

  • First-time customers: Full payment may be required before dispatch (as specified on the Pro Forma Invoice).
  • Large orders: Deposits may be accepted on a case-by-case basis and will be stated in the invoice.
  • Order processing begins once payment is confirmed.

Shipping, duties, and taxes are not included unless stated otherwise.

SECTION 5 – Shipping Methods

SECTION 6 – RETURNS, REFUNDS & DISPUTES

Eligible Return Reasons

  • Wrong item shipped.
  • Significant undisclosed damage.
  • Condition materially different from the description.

Non-Eligible Reasons

  • Market price changes.
  • Buyer’s change of mind.
  • Minor cosmetic variance within industry standards.

Return Process

  1. Notify us within 48 hours of delivery with photo evidence to contact@tcg-akiba.com.
  2. Return authorization will be issued where applicable.
  3. Return the item in original condition and packaging.
  4. Refund or replacement will be processed after inspection, if applicable.

Disputes will be handled professionally and may proceed to mediation under Japanese commercial law if necessary.

SECTION 7 – INTELLECTUAL PROPERTY & CONTENT PROTECTION

Copyright Notice

All content on https://tcg-akiba.com/—including text, product descriptions, images, pricing systems, processes, PDF documents, and communication templates—is the exclusive property of TCG-AKIBA and is protected under Japanese and international copyright laws.

Prohibited Actions

You are strictly prohibited from:

  • Copying, scraping, translating, or reproducing any part of our website or business content without written permission.
  • Reusing our images, product descriptions, pricing lists, or Terms of Service text.
  • Automated data collection (scraping) or reverse-engineering of our systems.
  • Using our business documentation or processes for competitive purposes.

Enforcement

Unauthorized use, copying, or reproduction of our content may result in immediate termination of business relationship, DMCA takedowns where applicable, and civil claims under applicable copyright laws. TCG-AKIBA actively monitors for unauthorized use and enforces its rights.

Trademark Notice

Pokémon, One Piece, Dragon Ball, Yu-Gi-Oh!, and other trading card game names are trademarks of their respective owners. TCG-AKIBA is an independent reseller and is not affiliated with or endorsed by these trademark holders.

SECTION 8 – CONFIDENTIALITY

During our business relationship, both parties may exchange confidential information such as pricing structures, supplier details, business strategies, and customer lists. You agree to keep such information confidential and to use it only for the purpose of conducting business with TCG-AKIBA. Confidentiality obligations continue after termination of the business relationship.

SECTION 9 – LIMITATION OF LIABILITY

To the maximum extent permitted by law, TCG-AKIBA shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, business opportunities, or data. Our aggregate liability for any transaction is limited to the amount paid for that transaction, except where liabilities cannot be limited under applicable law.

SECTION 10 – INDEMNIFICATION

You agree to indemnify and hold harmless TCG-AKIBA and its officers, directors, employees, and agents from any claim or loss arising from your breach of these Terms, violation of law, misuse of products, or unauthorized use of our brand or documents.

SECTION 11 – PROHIBITED USES

Prohibited conduct includes but is not limited to:

  • Fraudulent activities or providing false information.
  • Illegal resale or evasion of customs or taxes.
  • Impersonation of TCG-AKIBA or misrepresentation of affiliation.
  • Unauthorized scraping, hacking, or transmitting malicious code.
  • Money laundering, sanctions evasion, or terrorist financing.

Violation may result in immediate termination of services and legal action.

SECTION 12 – FORCE MAJEURE

Neither party shall be liable for any failure or delay caused by events beyond reasonable control, including natural disasters, war, government action, pandemics, strikes, carrier failures, or other force majeure events. If a force majeure event continues for more than 30 days, either party may terminate the affected transaction without liability.

SECTION 13 – TERMINATION

We may terminate service or refuse business if you breach these Terms, provide false information, engage in illegal conduct, or harm our business reputation. Outstanding invoices remain due after termination. Confidentiality obligations survive termination.

SECTION 14 – GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of Japan. Jurisdiction for disputes shall be the Tokyo District Court. Parties will first attempt good-faith negotiation, followed by mediation; arbitration or litigation may be pursued if necessary. The English version of these Terms prevails.

SECTION 15 – PRIVACY & DATA PROTECTION

We collect and process business-related information necessary to execute transactions. We do not sell personal business data. Data is retained and managed in accordance with applicable laws and our Privacy Policy.

SECTION 16 – MISCELLANEOUS

  • These Terms constitute the entire agreement between you and TCG-AKIBA regarding the subject matter herein.
  • If any provision is found invalid, the remainder remains in effect.
  • Assignment of rights requires written consent.
  • Notices should be sent to contact@tcg-akiba.com.

SECTION 17 – ACKNOWLEDGMENT

By communicating with or purchasing from TCG-AKIBA, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, and that you are authorized to act on behalf of your business.
